1. Is an alcoholic blackout grounds for a defense? (NO, and worse if you are driving. There are exceptions, i.e. someone slipped something into your drink – some need to prove specific intent.)
- DISCUSSION of vehicular manslaughter.
- REPORT that some cars have a built-in breathalyzer.
2. Is a bar or homeowner liable if you leave them drunk? (Yes, in CA. it is called a “dram shop” and the homeowner could be liable.)
- FOCUS OF ROBERT’S PRACTICE.
1. Personal bankruptcy. There are lots of chapters in personal bankruptcies. Either Chapter 7 where you get all your debts discharged as long as you get rid of all the secured items. Mortgages also. You CANNOT discharge student loans, judgements against you from a DUI, or a tort, or your last 3 years of income taxes. Or Chapter #13 where if you make more than the median income in CA ($70,000/yr for a single person) you MUST do a 13. Chapter 13 has a payment plan.
2. BK will be on your FICA for 10 years.
- REPORT that when you file a Chapter 7 Robert can get you a 700-credit score in a year if you do what he says.
